KUALA LUMPUR, Feb 20 — The High Court today dismissed an appeal by fashion designer Datuk Jovian Mandagie to overturn a bankruptcy order issued against him after he failed to repay a friendly loan amounting to RM5.28 million, inclusive of interest, to engineering firm Cekap Air Sdn Bhd.

KUALA LUMPUR, Feb 20 — The High Court today dismissed an appeal by fashion designer Datuk Jovian Mandagie to overturn a bankruptcy order issued against him after he failed to repay a friendly loan amounting to RM5.28 million, inclusive of interest, to engineering firm Cekap Air Sdn Bhd.

Counsel Siti Nur Athirazatti Rohizad, appearing for Cekap Air, said the court also rejected Jovian’s bid to stay the bankruptcy order.

“The court dismissed the appeal to set aside the creditors’ petition and refused the stay application, with costs of RM10,000 awarded,” she told reporters following proceedings before Judge Jamhirah Ali in chambers.

On July 3 last year, Senior Assistant Registrar Muhammad Faisal Zulkifli granted the bankruptcy order after allowing the creditors’ petition filed on November 20, 2024.

Earlier, on May 21, 2024, Cekap Air issued a bankruptcy notice after Jovian failed to comply with a direct judgment handed down on April 2, 2024.

According to the petition, the company sought a bankruptcy order against Jovian for failing to settle RM5,284,340.66, including interest, as directed by the High Court.

On April 2, 2024, Judge Datuk Ahmad Fairuz Zainol Abidin allowed Cekap Air’s application for direct judgment, ordering Jovian to repay the loan. The decision was made based on written submissions without proceeding to a full trial.

Cekap Air had filed the suit on May 16, 2023, claiming that Jovian had not repaid RM5 million allegedly loaned to him based on his friendship with the company’s director, Yong Zhen Wei.

The company said it transferred RM5 million on February 25, 2022, to the client account of the law firm representing Jovian following his verbal request, with repayment to be made within 12 months.

It maintained that the loan was extended informally on the basis of trust and friendship, citing Jovian’s involvement in several other businesses as reason for confidence in him.

However, Cekap Air alleged that Jovian breached the agreement and had yet to return the sum, resulting in financial losses to the company. Jovian filed his defence on June 20, 2023. — Bernama
