WASHINGTON, Feb 26 — A US federal judge has ruled that the Trump administration’s policy of deporting undocumented migrants to third countries without prior notice is unlawful.

District Judge Brian Murphy said the policy allows authorities to remove individuals to countries that are not their own — including places where they could face persecution or torture — without giving them a chance to object. “It is not fine, nor is it legal,” he wrote, rejecting the Department of Homeland Security’s position that such removals are acceptable if officials believe migrants will not be harmed upon arrival.

Murphy said the policy fails to meet due process standards required by Congress, questioning the credibility and transparency of so-called “assurances” from receiving countries. He put his order on hold for 15 days to allow the government to appeal.

The administration has defended third-country deportations as necessary when migrants’ home countries refuse to accept them. — AFP
